Terms and Conditions

These Terms and Conditions (Terms) apply to all contracts between BuddAI and our customers regarding the use of our AI-powered desktop application and the associated services.

Deviating conditions of the customer will not be recognized unless we have expressly agreed to their validity in writing.

BuddAI offers a desktop software application that uses artificial intelligence to help users with various tasks, including but not limited to:

• Text analysis and editing
• AI-assisted work support
• Automation of routine tasks
• Integration with various applications

The contract is formed through registration on our platform and confirmation by the user. By registering, the user agrees to these Terms and Conditions.

Registration is only possible for persons aged 18 and over or with the consent of their legal guardians.

We provide the software and associated services with the utmost care. However, we cannot guarantee 100% availability.

Maintenance work, updates and technical disruptions may lead to temporary interruptions. We strive to keep such interruptions to a minimum.

The customer receives a non-exclusive, non-transferable right to use the software for the duration of the subscription.

The following actions are prohibited:

• Reverse engineering, decompilation or disassembly of the software
• Commercial redistribution without express permission
• Use for illegal or harmful purposes
• Circumvention of security measures

Current prices can be viewed on our website. All prices include statutory value-added tax.

Subscription fees are due monthly or annually in advance, depending on the selected plan. Payment is processed through our payment service provider Stripe.

In case of payment default, we reserve the right to suspend access and charge reminder fees.

The subscription can be cancelled at any time at the end of the current billing period. Cancellation must be made in writing or through the platform.

In case of violations of these Terms and Conditions, we reserve the right to terminate the subscription without notice.

Right of withdrawal for consumers: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of contract conclusion.

The protection of your personal data is important to us. Details on data processing can be found in our Privacy Policy.

We implement modern security measures to protect your data. However, 100% security cannot be guaranteed.

BuddAI integrates with third-party artificial intelligence services, including Google AI services, to provide enhanced functionality. By using our application, you acknowledge that:

• Your interactions with AI features may be processed by third-party AI providers
• We follow all applicable guidelines and policies of our AI service providers
• Third-party AI services are subject to their respective terms of service and privacy policies

Withdrawal Instructions

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of contract conclusion.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).

Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

Exclusion of the right of withdrawal: The right of withdrawal expires for digital content when we have begun to execute the contract after you have expressly consented and acknowledged that you thereby lose your right of withdrawal.

Limitation of liability: We are only liable for damages in cases of intent and gross negligence. Liability for slight negligence is excluded, unless essential contractual obligations (cardinal obligations) are affected.

Warranty: To the extent legally permissible, we exclude warranty. This does not apply to damages from injury to life, body or health or to damages from the breach of essential contractual obligations.

Maximum liability limit: Liability for financial losses is limited to typical, foreseeable damage and amounts to a maximum of the contractual sum paid in the year before the damaging event.

Software liability disclaimer: The software is provided "as is". We do not guarantee error-free operation, uninterrupted operation or suitability for specific purposes.

Data loss: We are not liable for data loss insofar as this could have been avoided by appropriate data backup measures on the part of the user.

We reserve the right to change these Terms and Conditions. Changes will be communicated to users at least 30 days before they take effect.

If the user does not object to the changes within 30 days after notification, the changes are deemed accepted.

We are not willing or obliged to participate in dispute resolution procedures before a consumer arbitration body.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is Munich, provided the customer is a merchant, a legal entity under public law or a special fund under public law.

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
